An unfortunate truth in the property management business exists: Sometimes tenants fall behind in rent. And while it is important to note that under the Fair Debt and Collection Act property managers are not considered debt collectors, rent delinquencies and rent collection are still problems. The Fair Debt and Collection Acts purpose is to prevent abusive practices in consumer debt collection, to encourage fair debt collection, and to enable consumers to dispute or validate the accuracy of debt information. It sets guidelines for debt collectors regarding appropriate business practices, defines rights of consumers involved with debt collectors; and recommends penalties for violating the act. When a property managers rent collection is incidental to his or her fiduciary duties to the property owner, he or she is not considered a debt collector, and therefore falls outside the statute. Still, managers worry that attempting to acquire rent might result in legal troubles because they are subject to other lawsuits related to rent collection. Also, while the act is a federal statute, various state and common law causes of action may apply to managers. The act protects consumers whose financial obligation arises primarily for personal, family or household purposes. Collection efforts relating to commercial, office, retail and other non-residential property fall outside the act, which makes residential managers much more vulnerable. Residential managers should work out a protocol for proceeding when rental payments fall into arrears. They should speak with an attorney about a roadmap that can be followed safely without running afoul of the law. Managers must make sure theyre up-to-date on new laws or court decisions that might govern their conduct, and they should exceed the standards imposed by the legislature and courts–it will help to avoid liability and high legal fees.
BANGKOK, Oct. 15 Kyodo The Asia-Pacific Economic Cooperation (APEC) forum is poised to strengthen the legal systems related to debt collection in the region, according to an internal report obtained by Kyodo News. The report, titled 2003 Study on Debt Collection Litigation/Arbitration in APEC Economies, is due to be submitted to APEC ministers assembling in the Thai capital on Friday and Saturday. It is intended to motivate member economies to take actions for further improvement of the laws and regulations on debt collection and their enforcement with an eye to establishing sound and predictable debt collection systems, the report says. Specifically, the report suggests regional cooperation be accelerated by aggregating best practices for a better debt collection system and developing human resources, particularly personnel involved in alternative dispute resolution (ADR) procedures, such as mediation and arbitration.

At the state level, legislatures and regulatory bodies continued strong supervision over debt collection operations and practices. Nevertheless, ACA International and its state and regional units continue to meet the challenges resulting from this growing focus on our industry. State units achieved numerous victories last year promoting laws beneficial to the industry and opposing legislation that would be detrimental to creditors and debt collectors nationwide. We consider the problem of optimizing the time for loading and unloading containers to and from a ship at a container terminal, where containers are required to be transported by trucks between the ship and their designated locations in the container yard. Generally speaking, a container terminal consists of the quayside, where containers are unloaded from and loaded onto ships, and the container storage yard, where containers are stored. External trucks are responsible for taking containers in and out of a container terminal. Internal trucks are responsible for transporting containers within the terminal, mainly between the container yard and the quayside. When a ship arrives at the terminal, containers are first unloaded from the ship onto the internal trucks by quay cranes. Next, the internal trucks transport the containers to their prespecified locations in the container yard. Upon arrival at the container block, a container is unloaded from the truck by a yard crane. After most of the containers have been unloaded from the ship, the outbound containers are transported from the storage yard to the quayside by those internal trucks and are loaded onto the ship by the quay cranes. Typically, several quay cranes can work in parallel to serve a ship, where each crane is designated to handle one section of the ship. To maximize the efficiency of this operation, it is important to have the turnaround time of the ship minimized. The speed of this loading/unloading operation is limited by the availability of the quay cranes and trucks. A quay crane can handle only one container at a time, and also a truck can normally only transport one container at a time. The yard cranes, on the other hand, have more capacity, and they usually spend their spare time shuffling the containers within a container block so as to reduce the loading/unloading time of the future tasks. Research related to the efficiency of container terminal operations has appeared in the literature. This includes the use of queuing models to study the utilization of container terminal capacity, see for example, Easa (1987), Daganzo (1990), and Gransberg and Basilotto (1998). It also includes the studies of operational issues such as berth allocation (Brown et al., 1997; Li et al., 1998; Lim, 1998), crane movements (Daganzo, 1989; Peterkofsky and Daganzo, 1990; Kim and Kim, 1999), storage allocation (De Castilho and Daganzo, 1993; Kim et al., 2000; Bish et al., 2001; Bish, 2003), and vehicle dispatching (Bostel and Dejax, 1998; Powell and Carvalho, 1998). Recently, Bish et al. (2001) considered a vehicle dispatching problem in a container terminal. In their model, containers are first unloaded from a ship by quay cranes following a prespecified sequence (known as “crane job sequence”). The unloaded containers are transported to their destinations in the container yard by a fleet of identical vehicles, each of which can carry one container at a time. Another set of containers are then transported from the yard by the same set of vehicles and are loaded onto the ship, also following a prespecified sequence. It is assumed that the travel times of vehicles satisfy the triangle inequality. The time that a quay crane needs to load/unload a container is assumed to be the same for all the jobs. The objective is to determine a vehicle schedule so as to minimize the makespan, i.e., the time it takes to complete the entire loading/unloading operation for the ship. They developed optimal and heuristic solution procedures for solving this problem. They performed worst-case analysis as well as computational analysis on their heuristic method for the single quay crane case of the problem. Their computational analysis is further extended to the multiple quay crane case. In this paper, we build on the work of Bish et al. (2001). We relax the assumption that the loading and unloading time of container is the same for all the jobs. In the presence of a single crane, we present an optimal algorithm which is efficient for small problems. For large problems, we provide a lower bound procedure as well as heuristics with favorable worst-case error bound and fast asymptotic convergence. Our analyses for the single crane case are supported by extensive computational experiments on randomly generated problems.

Fretting that there are just not enough hours in the day? Considering a new career? Cant decide what you really want out of life? Theres a growing field ready to help people having trouble getting ahead in the game of life: life coaching. The life coach is a blend of cheerleader, job counselor, confidante and mentor, generally working over the phone or through e- mail. “Imagine a relationship that is totally focused on you: where you are in your life, where you want to go, what your dreams are,” says Kathy Michel Schnorr, a life coach in Colorado Springs. In 1992, Thomas Leonard, a former financial planner who is considered the father of life coaching, founded Coach U, the first training institute for coaches. Leonard died this year, but the industry he helped spawn is thriving, with an estimated 10,000 to 15,000 life coaches working in the United States.
Many nurses may be familiar with life coaching or executive coaching. Coaching is a partnership between coach and client. The coaching process is designed to support clients as they work toward fulfilling personal and professional goals. While life and executive coaching may be the most well-known forms of coaching, the approach and methods of coaching have been extrapolated into other areas or niches. One of these is AD/HD coaching. “A designed partnership that combines coaching skills with knowledge of attention deficit disorder, a neurobiological condition. The coaching process enhances quality of life, improves performance, and supports growth and change. The purpose of AD/HD coaching is to provide support, structure, and accountability. Coach and client collaboratively explore strengths, talents, tools, and new learning to increase self-awareness and personal empowerment. Together they design strategies and actions and monitor progress by creating accountability in line with goals and aspirations” (IAAC, 2007). AD/HD coaching was brought into the spotlight as an intervention for the treatment of adult AD/HD by Hallowell and Ratey (1994) in their seminal book, Driven to Distraction. At that time, professionals focused mainly on educational accommodations and therapy for children and teens with AD/HD. Little had been written about coaching for youth with AD/HD, and the focus on youth coaching was centered on academics. Academic and educational coaches were available to students needing support, with a strong recommendation of academic coaching for struggling students with AD/HD and learning disabilities. Help4ADD@HighSchool (Nadeau, 1998) was one of the first books to discuss AD/HD coaching on a larger scale, reaching beyond simply academic coaching. In her book, Dr. Nadeau states, “Coaching is one of the best ways to deal with your ADD. A coach provides external structure and support, and teaches [you] how to develop your own internal structure” (p. 62). Coaching helps children and teens with AD/HD with several key challenges they face. First, coaching helps a child/teen learn techniques for maintaining focus, stay on task, and improve time management and organizational skills. The development of these skills can contribute to smoother family life and improved school performance. These skills are also the building blocks for future success. Second, by initiating the coaching process with school-aged children, coaches are able to help students with AD/HD avoid frustration and keep motivated, as well as help them build self-confidence and self-awareness during the formative years. Third, most children benefit from daily routines and structures, and building structure and predictability through routines is an effective tool for parents of challenging children with AD/HD (Heininger Weiss, 2001). Yet, routines can be difficult for the child with AD/HD to maintain, and a busy parent can easily be thrown off a routine when a child has AD/HD. Additionally, many parents of children and teens with AD/HD have attentional issues themselves and find it difficult to keep up with a plan on a daily basis. With the support of a well-trained AD/HD coach (IAAC, 2007), effective structure and routines can be developed and sustained, facilitating the consistency that allows children with AD/HD and related behavioral issues to thrive. This can be done with support, care, and humor to protect and build the self-esteem of everyone involved.

Researchers developed an approach that included education about the biological and psychological determinants of body weight, weight loss, and weight regain; cognitive behavioral treatment (CBT) methods to enhance self-esteem and body image (independent of weight); and instruction in behavioral methods of weight control. These investigators report changes in weight, body image, and serf-esteem associated with a novel treatment after 40 weeks of treatment and at a 1-year follow-up (that is, week 92). They also compare these results with those obtained in published trials of standard behavior treatment. Subjects were 17 obese women with a mean age of 46.5 [+ or -] 9.7 years, a mean weight of 92.8 [+ or -] 9.1 kg, and a mean BMI of 34.7 [+ or -] 2.9 kg/[m.sup.2]. Thirteen were white (76.5%), and four were African American (23.5%). The program was designed to alter patients expectations and to promote the acceptance of realistic weight loss outcomes (that is, approximately a 10% weight loss). Subjects were treated in groups of 7 to 10 persons and attended 20 weekly sessions, 5 monthly sessions (over 20 weeks), and a 1-year follow-up visit. The 40-week intervention consisted of four phases. During phase 1 (weeks 1 to 4), the subjects were instructed to refrain from making any changes in their eating or activity habits to focus entirely on examining their weight loss goals and expectations. Phase II of the program (weeks 5 to 12) focused on the development of weight control skills. The subjects were instructed to consume a self-selected diet of 1200 to 1500 kcal/day and were trained in the standard cognitive behavioral methods of weight control. Phase III (weeks 13 to 20) focused on methods to improve body image and self esteem. And finally, phase IV of the program (weeks 24 to 40) focused on developing weight maintenance skills. Weight was measured at each treatment visit. Changes in weight, self-esteem, body image, and quality of life were assessed at the end of treatment and 1 year later. At week 40, participants lost an average of 5.7 [+ or -] 5.3% of initial weight, which was associated with significant improvements in body image, self-esteem, and quality of life. Improvements in psychosocial status were maintained at week 92, although mean weight loss at this time had declined to 2.9 [+ or -] 5.6% of initial weight. Increased satisfaction with body weight at week 40 was associated with significantly better maintenance of weight loss at follow-up (r = -70; p = 0.02).
